{"id":9723,"date":"2013-03-10T03:17:35","date_gmt":"2013-03-10T02:17:35","guid":{"rendered":"https:\/\/www.anglinglines.com\/blog\/?p=9723"},"modified":"2024-11-28T13:30:43","modified_gmt":"2024-11-28T12:30:43","slug":"new-french-driving-laws-is-a-breathalyser-a-legal-requirement","status":"publish","type":"post","link":"https:\/\/www.anglinglines.com\/blog\/new-french-driving-laws-is-a-breathalyser-a-legal-requirement\/","title":{"rendered":"Is A Breathalyser A Legal Requirement in France?"},"content":{"rendered":"<h3><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-14768\" alt=\"breathalizer in france\" src=\"https:\/\/www.anglinglines.com\/blog\/wp-content\/images\/2013\/03\/breathalizer-in-france.jpg\" width=\"347\" height=\"205\" srcset=\"https:\/\/www.anglinglines.com\/blog\/wp-content\/images\/2013\/03\/breathalizer-in-france.jpg 347w, https:\/\/www.anglinglines.com\/blog\/wp-content\/images\/2013\/03\/breathalizer-in-france-300x177.jpg 300w, https:\/\/www.anglinglines.com\/blog\/wp-content\/images\/2013\/03\/breathalizer-in-france-150x89.jpg 150w, https:\/\/www.anglinglines.com\/blog\/wp-content\/images\/2013\/03\/breathalizer-in-france-104x62.jpg 104w\" sizes=\"auto, (max-width: 347px) 100vw, 347px\" \/><\/h3>\n<div><span style=\"color: #ff6600;\"><em>Readers Question;\u00a0Is it true the French Government have decided to postpone the need to have a breathalyser for now?<\/em><\/span><\/div>\n<div><\/div>\n<div><em>Below is the information received from the ACF (Automobile Club de France):<\/em><span style=\"color: #0000ff;\">From the 1st July 2012 a new sanction was enforced, in France, obliging every driver to carry an unused breathalyser kit in their vehicles.<\/span><span style=\"color: #0000ff;\">Drivers that fail to comply are liable to a 11 Euro fine.<\/span><span style=\"color: #0000ff;\">The enforcement of this sanction was postponed until 1st November 2012 to allow time for drivers to equip themselves.<\/span><span style=\"color: #0000ff;\">Furthermore, a decree was issued on the 29th October 2013 to further delay enforcement, possibly until 1st March 2013, due to a shortage in supply of breathalysers.\u00a0<\/span><span style=\"color: #0000ff;\">A few days ago, Manuel Valls announced that the obligation was to be postponed indefinitely (sine die) awaiting the conclusions of the French National Counsel for Road Safety (Conseil national de la s\u00e9curit\u00e9 routi\u00e8re) expected in February.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">For now the text obliging drivers to possess a breathalyser still appears in the \u2018Code de la Route\u2019 (highway code) and has not been revoked.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">Currently the text is as follows:<\/span><\/p>\n<p><span style=\"color: #0000ff;\">Breathalyser obligatory: Yes \/ regulation: no, not before the 1st March 2013.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">We are paying close attention to the Government\u2019s decisions and to the repeal of the texts which will take place if the requirement for a breathalyser is eventually renounced.<\/span><\/p>\n<p><span style=\"color: #0000ff;\">We shall not fail to keep you informed.<\/span><\/p>\n<p>So, the legal requirement to carry a breathalyzer is still in the highway code, but you cannot be fined for not carrying one.
